Terms of Service for Nutri-E¶

1. Acceptance of Terms¶

By downloading, installing, or using Nutri-E ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service¶

Nutri-E is a personal nutrition tracking application that helps you: - Track dietary supplements and their nutrient content - Monitor daily nutrient intake from food and supplements - Set supplement schedules and reminders - Analyze food using AI-powered image recognition - Access supplement information from the NIH DSLD database

3. Medical Disclaimer¶

IMPORTANT: Nutri-E is NOT a medical device and does NOT provide medical advice.

The App is for informational and tracking purposes only
Always consult a qualified healthcare provider before starting any supplement regimen
Do not use the App to diagnose, treat, cure, or prevent any disease
RDA (Recommended Daily Allowance) values are general guidelines and may not apply to your specific needs
AI-powered food analysis may contain errors - always verify nutritional information
The App does not replace professional medical, nutritional, or dietary advice

Use at Your Own Risk¶

You assume all responsibility for using the App and any actions taken based on its information.

4. Subscription Terms¶

4.1 Subscription Tiers¶

Free: 10 AI lookups to start, then 3 per week (max 10 stored)
Basic: 10 AI lookups per day - $4.99/month
Pro: 50 AI lookups per day - $11.99/month
Premium: 160 AI lookups per day - $24.99/month
Ultimate: 500 AI lookups per day - $39.99/month

4.2 Billing¶

Subscriptions are billed monthly through Apple In-App Purchases
Payment is charged to your Apple ID at confirmation of purchase
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period
Pricing may vary by region based on Apple's pricing matrix

4.3 Cancellation¶

Cancel anytime in iOS Settings → [Your Name] → Subscriptions
Cancellation takes effect at the end of the current billing period
No refunds for partial months
You retain access to paid features until the subscription expires

4.4 Free Trial¶

If offered, free trials convert to paid subscriptions unless canceled before trial end
Manage trials in iOS Settings → Subscriptions

5. AI Usage Limits¶

5.1 Fair Use¶

AI lookups are for personal, non-commercial use only
Do not abuse the service with automated requests or excessive usage
We reserve the right to restrict access if abuse is detected

5.2 Accuracy¶

AI-powered features use GPT-4 Vision and may not be 100% accurate
Always verify supplement labels and nutritional information manually
Report inaccuracies through the app feedback feature

6. User Responsibilities¶

6.1 You Agree To:¶

Provide accurate health information (age, gender) for personalized recommendations
Use the App in compliance with all applicable laws
Not reverse engineer, decompile, or attempt to extract source code
Not use the App for illegal or unauthorized purposes
Keep your device and App updated for security

6.2 You Agree NOT To:¶

Share your subscription with others (violations may result in termination)
Use the App to harm others or distribute malware
Attempt to bypass AI usage limits or subscription requirements
Scrape, data mine, or extract bulk data from the App

7. Intellectual Property¶

7.1 App Ownership¶

Nutri-E and all related content, features, and functionality are owned by Invotek
The App is licensed, not sold, to you
You may not copy, modify, distribute, or create derivative works

7.2 Your Data¶

You retain ownership of all data you enter into the App
We claim no ownership over your supplement lists, food logs, or personal information
You grant us a limited license to process your data to provide App features

7.3 Third-Party Content¶

NIH DSLD supplement data is provided by the U.S. National Institutes of Health
Nutritional databases are from public domain sources (USDA, etc.)

8. Third-Party Services¶

8.1 Apple In-App Purchases¶

Governed by Apple's Terms of Service
Refunds handled by Apple per their refund policy

8.2 OpenAI API¶

AI features use OpenAI's GPT-4 Vision API
Subject to OpenAI's Terms of Use and Privacy Policy
We are not responsible for OpenAI service interruptions

8.3 NIH DSLD Database¶

Supplement data from the NIH Dietary Supplement Label Database
We are not responsible for inaccuracies in the DSLD data
DSLD is a public resource provided "as is"

9. Privacy and Data¶

Your privacy is governed by our Privacy Policy
We store data locally on your device (Core Data)
AI features send images/text to OpenAI's API (not stored by us)
No personal data is sold or shared with third parties

10. Disclaimers and Limitations of Liability¶

10.1 No Warranties¶

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - Merchantability - Fitness for a particular purpose - Non-infringement - Accuracy of data - Uninterrupted service

10.2 Limitation of Liability¶

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVOTEK SHALL NOT BE LIABLE FOR: - Any indirect, incidental, special, or consequential damages - Loss of profits, data, or goodwill - Health issues arising from supplement use - Errors in nutritional calculations or AI analysis - Service interruptions or data loss

Maximum Liability: Our total liability shall not exceed the amount you paid for the App in the past 12 months.

11. Indemnification¶

You agree to indemnify and hold harmless Invotek from any claims, damages, or expenses arising from: - Your use of the App - Your violation of these Terms - Your violation of any third-party rights - Any health issues related to supplement use based on App data

12. Termination¶

12.1 By You¶

Uninstall the App at any time
Cancel subscriptions in iOS Settings

12.2 By Us¶

We may terminate or suspend your access if you: - Violate these Terms - Abuse the service or AI features - Engage in fraudulent activity - Use the App in a harmful manner

12.3 Effect of Termination¶

Your subscription will be canceled (no refund for current period)
You lose access to AI features
Local data remains on your device until you delete the App

13. Changes to Terms¶

We may update these Terms at any time
Significant changes will be notified via app update or in-app notice
Continued use after changes constitutes acceptance

14. Governing Law¶

These Terms are governed by the laws of Norway
Disputes shall be resolved in the courts of Norway
EU users retain rights under EU consumer protection laws

15. Severability¶

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

16. Entire Agreement¶

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Invotek regarding the App.

18. App Store Requirements¶

The App is distributed through the Apple App Store
Apple is not responsible for the App or these Terms
Apple is a third-party beneficiary of these Terms
In the event of conflict, Apple's terms prevail

19. Export Compliance¶

You agree to comply with all export laws and restrictions of Norway, the EU, and the United States.

20. Acknowledgment¶

BY USING NUTRI-E, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
